TERMS OF SERVICE

Services: APEX Recovery IV provides elective IV hydration services at mobile pop-up locations inside partnered gyms. All services are performed by licensed medical providers.

Eligibility: Services are available to individuals 18 years of age and older who pass our medical screening process. The licensed medical provider has final authority over treatment eligibility.

Booking and Payment: Bookings are confirmed upon completion of payment. Prices are listed at the time of booking and may vary between prebooked and walk-up rates. All payments are processed securely through Stripe.

Medical Screening: All clients must complete a health screening questionnaire before receiving services. Inaccurate or incomplete information may result in treatment being declined or modified.

Provider Authority: Final treatment eligibility, fluid selection, volume, additives, infusion rate, and treatment plan are determined by the licensed medical provider. The provider may modify or decline treatment based on clinical assessment.

Consent: By booking and receiving services, you consent to IV hydration therapy, acknowledge the risks described in our Medical Disclaimer, and agree to these Terms of Service.

Limitation of Liability: APEX Recovery IV is not responsible for outcomes beyond the standard of care provided by licensed medical professionals. We do not guarantee specific health outcomes or performance results.

Anti-Doping Acknowledgment: Athletes subject to WADA, USADA, UFC Anti-Doping, NCAA, or other governing-body rules are responsible for ensuring their use of IV hydration complies with applicable anti-doping regulations. Under WADA rules, IV infusions exceeding 100 mL within a 12-hour period are prohibited without a Therapeutic Use Exemption (TUE). APEX Recovery IV does not provide TUE documentation.

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law provisions.

Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided by APEX Recovery IV shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Maricopa County, Arizona. The arbitrator's decision shall be final and binding. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. Nothing in this clause prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
